- Introduction
- These Terms and Conditions apply to Users of the thedoghouse website (the Site). By using this Site, you accept and agree to these Terms and Conditions. Thedoghouse Users are also subject to the thedoghouse Membership Terms and Conditions.
- thedoghouse.co.uk Limited (04942528) (thedoghouse) reserves the right to change these Terms and Conditions at any time. Thedoghouse.co.uk will notify Users in writing of any changes made to these Terms and Conditions.
- Persons under the age of 18 are forbidden from becoming Users.
- For the avoidance of doubt, these Terms and Conditions only apply to the use of the Site. These terms and Conditions do not apply to any transactions entered into between a User and a Partner.
- Unless otherwise indicated, thedoghouse owns all copyright in the material on the Site. All registered or unregistered trademarks used on the Site are the property of their respective owners.
- Thedoghouse authorises you to print, copy, reproduce, download and view materials on the Site, subject to:
- the material being used in the intended manner;
- the material being used exclusively for non-commercial personal use; and
- the material not being modified in any manner.
- If you download material (including any software) from the Site, it is licensed to you by thedoghouse for non-commercial personal use only. You are expressly prohibited from licensing, selling, distributing, de-compiling, reverse engineering or otherwise dealing with it.
- Use of the Site
- You must not upload to, or distribute or publish through, the Site any inappropriate communication in any form. Inappropriate communications include obscene, harassing, pornographic, abusive, slanderous, defamatory, vulgar, threatening or offensive material.
- Commercial use of the Site is strictly prohibited.
- By uploading materials to the Site, you grant thedoghouse a non-exclusive, royalty free, perpetual license to use, modify, reproduce, distribute or otherwise deal with the uploaded material in any manner which thedoghouse deems appropriate. In addition, you agree to waive all "moral rights" in those materials.
- The Site contains trademarks, which may be registered or otherwise protected by law. These include the thedoghouse name and logo and the logos of various thedoghouse products. You are not permitted to use these trademarks.
- Privacy
- Thedoghouse's Privacy Policy will also apply to your use of this Site.
- Although thedoghouse has implemented security measures in relation to information uploaded to the Site, you acknowledge that the Internet is inherently insecure and that thedoghouse will not be responsible for any breach of security or unintended loss or disclosure of information in relation to the Site.
- We also collect information on the times and ways you use the Site. This information will be used for the purposes outlined in our Privacy Policy and to improve the operation of this Site.
- Information and services at the Site
- Thedoghouse updates the Site regularly; however thedoghouse makes no representation as to the accuracy, currency or completeness of any information or services at the Site. All information and services are provided on the basis that you undertake the responsibility for assessing at your own risk.

- The Site may from time to time provide access to other sites on the Internet via hyperlinks located on the Site. Thedoghouse is not responsible for the accuracy, legality, and decency of material or copyright compliance of any linked Site or services or information provided via any linked Site. Thedoghouse expressly disclaims any and all liability in relation to linked Sites. Thedoghouse is not responsible for and will not be liable in respect of the content or operation of those websites or any of the goods and services that they describe.
- You are not permitted to link to or frame the Site without thedoghouse's express written permission.
- Indemnity
- You must maintain the confidentiality of your password. You are entirely responsible for any and all actualities which occur in relation to transactions conducted by you via the Site. You hereby indemnify thedoghouse from any liability or expense arising from use or misuse of the Site by you, including in relation to any communication (including but not limited to data, images, video, text and/or sound), which you upload to the Site. You agree to notify thedoghouse immediately of any unauthorised transaction conducted by you via the Site.
- Jurisdiction
- These terms and conditions will be construed in accordance with, and are governed by, the laws of the England and Wales. The parties submit to the exclusive jurisdiction of the courts in and of England and Wales in relation to any dispute arising under these terms and conditions. Thedoghouse does not warrant or represent that the Site is appropriate for use in other locations where such content is or may be illegal, or may infringe any person's rights.
- Liability
- Thedoghouse and its related bodies corporate will not be liable for any loss, damage, claim, cost or expense incurred whatsoever in connection with the use of the Site. To the extent that any non-excludable warranties are implied into these conditions by law, thedoghouse's liability in respect of the Site is limited to re-supplying the relevant content or the reasonable cost of re-supplying the relevant Site, whichever thedoghouse elects to provide.
- Thedoghouse and its related bodies corporate will not in any case be liable for any direct or indirect lost profit or any indirect, consequential or special damages arising out of or in connection with the Site.
Membership Terms and Conditions

Introduction
These Terms and Conditions form the basis of the thedoghouse Reminder Service.
Please read these Terms and Conditions carefully before participating in the thedoghouse Reminder Service.
By participating in the thedoghouse Reminder Service, you signify your assent to these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not participate in the thedoghouse Reminder Service.
- Thedoghouse Reminder Service
thedoghouse.co.uk Limited (04942528) operates an online reminder and gift service, or services from retailers and service providers (Partners) aligned with the program (thedoghouse Reminder Service).
- Membership
- A person who wishes to become a User can apply for membership of the thedoghouse Reminder Service in the ways provided by thedoghouse from time to time.
- Thedoghouse may, at its absolute discretion, refuse any application for membership.
- A User must notify thedoghouse immediately of any change of address or other relevant personal information.
- Thedoghouse may terminate a User's membership in the thedoghouse Reminder Service without notice for any reason including, without limitation, if the User:
- fails to comply with these Terms and Conditions;
- abuses any privilege accorded to the User under the thedoghouse Reminder Service;
- supplies any misleading information or makes any misrepresentations to thedoghouse or to any participating Partner in connection with the thedoghouse Reminder Service;
- violates any law or regulation in connection with the, thedoghouse Reminder Service;
- commits an act, or acts of fraud or abuse involving any portion of the, thedoghouse Reminder Service; or
- takes any action that is to the detriment of the thedoghouse Reminder Service or any of its Partners.
- User may terminate his or her membership in the thedoghouse services at any time by writing to thedoghouse. On receiving a notice of termination from a User thedoghouse will remove your personal details from thedoghouse Database as soon as reasonably practicable thereafter.
- Any tax, liability, or duty arising from a User's participation in the thedoghouse Reminder Service is the responsibility of the User.
- Subject to this clause 2, if a User's membership application is successful, Users will be provided with a doghouse membership free of charge. For the avoidance of doubt, the aforementioned free membership DOES NOT include the free provision of SMS reminders, as a part of the SMS Function of the Site, nor does it relate in any way, to the free provision of gifts entailed in the 'GIFTS' section of the Site. Thedoghouse.co.uk reserves the right to introduce an Annual Membership for the aforementioned free membership providing it notifies Users in writing within a reasonable notice period prior to any changes being made.
- By becoming a member of thedoghouse, you agree to receive electronic and or other forms of communication from thedoghouse.co.uk, including, but not limited to, reminders, newsletters and offers.
- SMS Facility
The User may elect to be reminded of important dates by being notified via and SMS message sent directly to their mobile phones (SMS Facility). If the User elects to use the SMS Facility, the User hereby agrees to be charged an activation fee of 25p via their mobile phone bill. To activate this service a User will be required to respond via text message to an activation SMS sent directly to their mobile phone (in addition to agreeing to the Terms and Conditions), Users will then be charged a fee of 25p to respond this SMS and to activate their SMS Facility. If the User elects to use the SMS Facility, a User must select one of the payment options set out below to facilitate the SMS Facility for the purpose of SMS reminders.
Standard Service
A User may elect to use the standard SMS Facility. Users may select to take advantage of a pay-as-you-go option whereby a User will be charged 25p per SMS reminder or SMS alert directly to their mobile phone bills . This service is not available for credit card purchase. As a standard part of the SMS Facility, a user will be automatically supplied with 16 (sixteen) generic SMS reminders per year as a minimum, unless they choose to opt-out of this as part of the standard SMS reminder service. To opt-out of any part of this standard service, a User must 'un-tick' the pre-populated, generic reminders as they are presented to the user during the registration process. A user may opt-out of either SMS reminders or SMS alerts by de-activating these within a user's 'My Profile' section of their doghouse account, or by emailing us.
Billing
If a User elects to use the standard SMS Facility the User will receive the following SMS messages:
Activation £0.25p SMS message:
"Welcome to thedoghouse! To activate your SMS reminders, text SMS to 60030. Reminders will then be charged at 25p each."
Billing £0.25p SMS message:
"Thanks, your doghouse SMS alert service is now active! Visit www.thedoghouse.co.uk to personalise your reminder and information alerts and stay out of the doghouse!"
Text Parcel Options:
Parcel of 20 text message reminders: £4.50
A User may elect to purchase SMS reminders in parcels. A parcel of 20 text message reminders costs £4.50 (billed directly to User's mobile phone or payable by credit card). To activate this payment option, Users will be required to respond to a single activation SMS sent directly to their mobile phones. Following this response, a User will be sent three £1.50 billing messages which will complete their payment of £4.50 for this text message parcel.
The activation message that Users will receive is as follows:
"Your doghouse SMS alert service is now live. Text DOGHOUSE to 80160 for your 20 SMS lifelines! www.thedoghouse.co.uk"
The three billing messages that Users will receive are as follows:
"You now have 20 SMS lifelines to keep your paw on the pulse - www.thedoghouse.co.uk"
"Looking for a bit of hero worship? Let www.thedoghouse.co.uk save you looking thoughtless with timely reminders and cracking gift suggestions"
"Do not forget to add your pressing date reminders on www.thedoghouse.co.uk"
Users opting to pay by credit card for text message parcels will be automatically re-billed and issued with the same number of texts (as the original, or last purchase), after the initial parcel is used, unless they opt to unsubscribe or to change their payment option by emailing thedoghouse.co.uk
Users opting to pay for their text message parcels via their mobile phone bill, will be required to re-activate their SMS Facility by responding to a re-activation text message which is sent to them upon expiry of the active text message parcel. If Users do not respond to this re-activation text message, their SMS Facility will be automatically cancelled until such time as a User re-activates the facility online at www.thedoghouse.co.uk . Thedoghouse.co.uk Ltd reserves the right to change the above SMS charges at any time, and will endeavor to notify Users of any changes as soon as reasonably practicable.
Cancellation
Users may cancel their SMS service by logging onto 'My Profile' with their personal details and de-activating the SMS Facility where prompted. Or, for the avoidance of doubt, to cancel this service, Users should email their requests in writing. At the time of cancellation, any unused texts will be rendered invalid.
Thedoghouse accepts no responsibility for the accuracy, legality, decency of material, or copyright compliance of Mblox Ltd (SMS service provider) or services or information provided via www.mblox.co.uk. Thedoghouse expressly disclaims any and all liability in relation to Mblox Ltd; www.mblox.co.uk. Thedoghouse is not responsible for and will not be liable in respect of the content or operation of the www.mblox.co.uk or any of the services that they describe and/or provide.
Users will receive confirmation of the purchase of an SMS parcel by the receipt of a confirmation SMS text message directly to their mobile phone.
Users will be entitled to a 7-day cool off period within which the User may terminate User's annual subscription or purchase of SMS parcels. User may not terminate a purchase of an SMS parcel if User has used that SMS parcel.
Thedoghouse.co.uk Ltd will provide its agreed services within 28 days of purchase by User.
- Changes
Thedoghouse reserves the right to make any changes at any time without prior notice and at thedoghouse's absolute discretion, to these Terms and Conditions and the range of Partners. Thedoghouse will reasonably attempt to notify Users of any changes but will not be liable in any way for failure to do so.
- The Privacy Policy
- The Privacy Policy issued by Thedoghouse forms part of these Terms and Conditions, but will prevail over these Terms and Conditions to the extent of any inconsistency. Thedoghouse will not alter the Privacy Policy pursuant to paragraph 4, except after giving written notification to all Users and giving all Users who do not wish to be bound by the changed Privacy Policy the opportunity to withdraw from thedoghouse Reminder Service.
- Subject to the Privacy Policy, information from the thedoghouse Database will be made available to certain third party service providers involved in administering the, thedoghouse Reminder Service, including, but not limited to, Web Central (secure service provider); Mblox (SMS service provider) and Deep Metrix (data processing service provider).
- Information from the, thedoghouse Database will also be used by thedoghouse for marketing (direct and all other kinds), planning, product development, research and other commercial purposes for thedoghouse and on behalf of Partners.
- Each User consents and agrees to the provision of the information on the application form to thedoghouse and authorises thedoghouse to access the information contained in it.
- A User can request to see his or her personal information stored on the, thedoghouse Database. A request may be made by telephone, email or by writing to us. Thedoghouse would welcome any feedback from Users to correct any inaccuracies in respect of their personal information.
- Users have the option of not providing certain information requested by thedoghouse. However, Users should note that this may prevent thedoghouse from offering all of its services to Users or benefactors.
- Suspension or Termination of thedoghouse Reminder Service
User acknowledges that thedoghouse Reminder Service may be suspended or terminated at any time without prior notice for any reason whatsoever. Thedoghouse reserves the right to suspend or terminate thedoghouse Reminder Service at any time without prior notice. Thedoghouse will not be liable for the suspension or termination of thedoghouse Reminder Service for any reason whatsoever, including, but not limited to, the failure of any of thedoghouse's third party service providers to properly administer thedoghouse Reminder Service.
- No Warranties
- User understands that neither thedoghouse, nor the, thedoghouse Reminder Service, operate or control the products or services offered by Partners. Partners are responsible for all aspects of order processing, fulfilments, billing and customer service. Thedoghouse or the thedoghouse Reminder Service are not parties to the transactions entered into between Users and Partners. User agrees that participation in the thedoghouse Reminder Service is at the sole risk of the User and that the thedoghouse Reminder Service is provided "as is" and without warranties of any kind, express, implied or otherwise, including the implied warranties of title, fitness for a particular purpose, merchantability or non-infringement. Under no circumstances will thedoghouse, the thedoghouse Reminder Service or their affiliates be liable for any damages arising from the transactions between User and Partners or for any information appearing on Partner websites or any other website linked to the thedoghouse Website. In no event will thedoghouse, thedoghouse Reminder Service or their affiliates be liable to a User for any incidental, special or consequential damages of any kind that may result from the use of or the inability to use the, thedoghouse Reminder Service, regardless of whether thedoghouse, thedoghouse Reminder Service or their affiliates were made aware of the possibility of such damages, and regardless of whether such damages arise in contract, tort (including negligence) or otherwise. User authorises thedoghouse, thedoghouse Reminder Service and their affiliates to perform all actions necessary hereunder.
- All conditions and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any qualifying goods or services supplied under the thedoghouse Reminder Service are expressly excluded to the full extent permitted by law. Any liability thedoghouse may have to User under statute in respect of such goods and services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again or repairing, or paying the costs of repairing, the goods at thedoghouse's option.
- Partners do not have any authority, express or implied, to make any representation, warranty or statement on behalf of thedoghouse and thedoghouse accepts no liability in respect of such representations, warranties or statements, should they occur.
- Partner Policies
- Users who buy products or services from Partners will be deemed to be customers of those Partners. All rules, policies (including privacy policies) and operating procedures of Partners will apply to Users. Neither thedoghouse, nor the, thedoghouse Reminder Service is responsible for information provided by Users to Partners. Partners do not have authority to make any representations or commitments on behalf of thedoghouse.
- By agreeing to receive news and offers from carefully selected partners, you are consenting to thedoghouse.co.uk sending you electronic and or other forms of communication with information about carefully selected partners services and or offers.
- General
These Terms and Conditions are governed by and must be construed in accordance with the laws of England and Wales. Users submit to the exclusive jurisdiction of the courts of England and Wales in respect of all matters or things arising out of these Terms and Conditions.
